These Terms of Service (“Terms”) govern your access to and use of lucette (“we,” “us,” or “our”) and our website and services at lucette.app (the “Service”).

lucette is operated as a sole proprietorship by K. Quinones, based in New York, United States.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Account Registration

To use certain features of the Service, you must create an account by authenticating with your X (Twitter) account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You agree to provide accurate information and to keep your account information current. You must notify us immediately of any unauthorized use of your account.

Description of Service

lucette is a scheduling tool that allows you to compose and schedule posts and threads to be published on X (Twitter), Farcaster, and Threads at times you specify. The Service interacts with these platforms through their official APIs:

• X (Twitter): Via the X API
• Farcaster: Via the Neynar API
• Threads: Via the Meta Threads API

We do not guarantee that scheduled posts will be published successfully. Publication depends on factors outside our control, including API availability, your account status on each platform, and content compliance with each platform’s policies.

Subscription Plans and Payment

Free Tier

We offer a free tier with limited features. The specific limitations of the free tier may change at our discretion.

Paid Subscriptions

We may offer paid subscription plans with additional features. If you subscribe to a paid plan:

• You agree to pay all applicable fees as described at the time of purchase
• Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected)
• You authorize us to charge your payment method automatically for each billing period
• Payments are processed securely through our payment processor, Paddle

No Refunds

All payments are non-refundable. If you cancel your subscription, you will retain access to paid features until the end of your current billing period, but you will not receive a refund for any unused portion.

Price Changes

We reserve the right to change our prices at any time. Price changes for existing subscriptions will take effect at the start of the next billing period following notice to you.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Violate the terms of service, rules, or policies of any connected platform, including X, Farcaster, and Meta/Threads
• Post spam, including bulk unsolicited messages or automated engagement schemes
• Post illegal content or content that promotes illegal activities
• Conduct scams, fraud, or deceptive practices
• Harass, threaten, or intimidate others
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any part of the Service
• Use the Service in any manner that could damage, disable, or impair the Service

We reserve the right to determine, in our sole discretion, what constitutes a violation of these acceptable use terms.

Content

Your Content

You retain ownership of the content you create and schedule through the Service (“Your Content”). By using the Service, you grant us a limited license to store, process, and transmit Your Content solely for the purpose of providing the Service.

You are solely responsible for Your Content and the consequences of posting it. You represent and warrant that you have all necessary rights to Your Content and that Your Content does not violate any third party’s rights.

Content Removal

We do not actively monitor Your Content, but we reserve the right to remove any content that we believe violates these Terms or is otherwise objectionable.

Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by lucette and are protected by copyright, trademark, and other intellectual property laws.

The lucette name and logo are our trademarks. You may not use our trademarks without our prior written consent.

Third-Party Services

The Service integrates with the following third-party platforms:

• X (Twitter): Subject to X’s Terms of Service and Developer Agreement
• Farcaster (via Neynar): Subject to Farcaster’s protocol guidelines and Neynar’s Terms of Service
• Threads (Meta): Subject to Meta’s Terms of Service and Threads Supplemental Terms

Your use of these third-party services is subject to their respective terms and policies. We are not responsible for the practices of any third-party services.

If any platform changes their API, policies, or terms in a way that affects the Service, we may need to modify or discontinue features of the Service without liability to you.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• SCHEDULED POSTS WILL BE PUBLISHED SUCCESSFULLY OR AT THE EXACT SCHEDULED TIME
• THE SERVICE WILL MEET YOUR REQUIREMENTS
• ANY DEFECTS IN THE SERVICE WILL BE CORRECTED

The Service is currently in beta/early release. You acknowledge that the Service may contain bugs, errors, and other problems that could cause system failures.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LUCETTE, ITS OPERATOR, OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE SERVICE
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT
• ANY THIRD-PARTY CONDUCT ON THE SERVICE
• FAILURE OF SCHEDULED POSTS TO PUBLISH
• ANY OTHER MATTER RELATED TO THE SERVICE

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless lucette and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any third-party rights

Account Termination

Termination by You

You may delete your account at any time through the Service or by contacting us. Upon deletion, your scheduled posts will be canceled and your data will be deleted according to our Privacy Policy.

Termination by Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms or our acceptable use policies
• Conduct that we determine is harmful to other users, third parties, or the Service
• Extended periods of inactivity
• Requests by law enforcement
• At our sole discretion for any reason

Upon termination, your right to use the Service will immediately cease. Any scheduled posts will be canceled. We are not liable to you or any third party for termination of your account.

Effect of Termination

Sections that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically.

Governing Law and Disputes

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in New York, and you consent to the personal jurisdiction of such courts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and lucette regarding the Service and supersede any prior agreements.
